Complex where balcony collapsed sending woman to hospital has dozens of code violations

DEKALB COUNTY, Ga. — Channel 2 Action News has learned that the apartment complex where a woman fell after a balcony collapsed has more than two dozen code enforcement violations against it.

The incident happened over the weekend over at the Eagles Run Apartments at 2000 Bouldercrest Road, just south of McNair High School.

Channel 2′s Dave Huddleston learned there could be other citations the owners of the property could be hit with.

The owners of the complex have a date with DeKalb County Magistrate Court on July 26 after that woman fell about 15 feet--and she wasn’t the only one.

“Her mother heard her scream, went running out to where she was sitting a moment ago, there was no patio and she fell all the way down and landed right on top of her daughter,” attorney Steve McConnell said.

There’s a giant hole now where the concrete balcony used to sit.

McConnell said the family moved to the apartment in February.

“I can’t imagine that one deck that one patio is unique,” McConnell said.

A DeKalb County spokesperson told Huddleston the complex was hit with 26 code violations in September for no handrails and guard rails on porches, electric system problems as well as violation of payment of taxes.

A code inspector on site told Huddleston there are currently bad balconies in two buildings.

Other residents like Robert Bolton said there have been maintenance problems for months now, but he didn’t notice a problem with his balcony.

“I never felt it moving or anything, I would have said something about it. But i never seen it move,” Bolton said.
