Initially, police said Damis was going the wrong way, but now police said that’s not the case.

The last year has been challenging for Najah Francis and her little son, “It’s been about a year now since this happened,” said Francis. “We’re kind of taking it day by day. Trying to push through everything.”

Channel 2 Action News obtained the final report from Sandy Springs Police stating Damis didn’t cause the accident.

Parts of the report said, “After reviewing the videos, I found that the vehicle going the wrong way on the SR 400 SB exit ramp to Abernathy Rd, looked more like the blue in color, 2016 Hyundai Sonata that Zoe Robinson was driving.”

The report states Robinson was driving 85 mph, in a posted 65 mph zone, at the time of the collision.

Although the report said, “…her observed driving behavior from the traffic cameras does suggest she was possibly impaired before the collision,” police documented in the report that there was no information that Robinson was under the influence of drugs.

“Mr. Damis was wrongfully being portrayed as being responsible for this tragedy,” said Stephen Fowler, the family’s attorney.

Francis said she’s glad their son will know the truth, “So I didn’t want him growing up and seeing that his dad caused this accident.”

After the initial investigation, police said they got several e-mails from witnesses, including one who said they read the story on Channel 2 Action News and saw the plea for witnesses to come forward.

The report showed many of those witnesses said the car nearly hit them and were able to describe the vehicle to police, matching up with the other driver.
