East Point police told Channel 2′s Tom Jones they have arrested a suspect in the case, just not the shooter at this time.

In the meantime, the family of 34-year-old Scott Ray Melton says they won’t rest until his killer is captured.

“I used to change his diapers,” his sister, Brandy Davis, said.

She said Christmas will never be the same. That’s after Davis got the news her brother was shot and killed at the Family Dollar on Headland Drive and Delowe. It happened on Christmas Eve.

“Christmas Eve, we got the phone call from the medical examiner, as I was cooking my Christmas dinner,” Davis explained.

Davis says what hurts even more is the person who took her brother’s life is still on the street.

“It’s been a month, and nothing has been done,” Davis said.

Police say the U.S. Marshal’s Office is actively searching for the gunman. They didn’t want to release the suspect’s name because they didn’t want it to hinder them from catching him.

Officers did say the gunman was acting as a security guard at the store. But officers say he wasn’t hired by the store.

Instead, he was hired by the store manager, who police say is his girlfriend. Officers say they arrested her for obstruction after she lied about communicating with their suspect after he disappeared.

Police say surveillance video captured the incident. They say it shows Melton did nothing wrong.

“I just want answers. That’s all,” Davis said.

She says her family wants to know why the gunman killed her brother and why it’s taking so long to get him into custody.

Davis had this message for the shooter: “God help you. All I can do is pray for you and that I will do. But I want you off the streets.”

East Point Police Chief Shawn Buchanan wants the family to know he understands their frustration. He says officers are doing everything in their power to get the gunman in custody.

Jones reached out to Family Dollar’s corporate office for a comment but did not hear back.
